2. Prices and products
The prices listed in the catalog of the SITE www.loja.safetymar.pt are in Euros and include VAT at the legal rate in force at the time of purchase, to which the applicable shipping costs must be added.
The prices and specifications of the products contained on this SITE may be changed by SafetyMar, Lda, without any prior notice.
Any product contained on the SITE may be withdrawn without prior notice, due to information received from the manufacturer/distributor regarding a stock-out or because it has been discontinued from production/distribution.
3. Ordering
The possibility of placing orders in the online store of the SITE www.loja.safetymar.pt is restricted to orders where the delivery and billing addresses are located in the territory of Mainland Portugal and the Autonomous Regions (Azores, Madeira).
Orders for delivery to P.O. Boxes are not accepted.
Orders requested from outside the territory of Mainland Portugal and the Autonomous Regions will be handled via a specific quote sent to the email geral@safetymar.pt.
The products presented in the online catalog are limited to existing stock. In the event of the unavailability of an item, SafetyMar, Lda. will inform the customer within a maximum period of 72 hours.
For some duly identified products, the order may be limited to a certain number of units.

4. Order delivery and shipping costs
All orders confirmed by SafetyMar, Lda. will be sent to the address specified by the customer for delivery at the time of the order.
The transport costs associated with each order will be calculated in accordance with the following table:

5. Payment methods
The customer may use the following payment methods:

The Customer must keep a copy of the payment receipt.
6. Order cancellation
The customer may cancel the order, provided that it has not yet been processed by SafetyMar, Lda.
The cancellation of the order can be formalized via email to the address geral@safetymar.pt .
The customer must mention the order number and their Tax Identification Number (NIF), otherwise the cancellation will be ineffective.
7. Non-acceptance of order
SafetyMar reserves the right not to accept the order, informing the Customer, in the following cases:
a) Stock-out
b) Unavailability of the item;
c) If SafetyMar considers there to be an incorrect query by the buyer or inconsistency in the personal data provided.
8. Returns
The customer may, within 14 days after receipt of the product, proceed with its return. Within the same period, the customer may file a claim for any defects or inadequacy of the product in relation to what was ordered, which is the responsibility of SafetyMar, Lda.
SafetyMar, Lda. will only accept products accompanied by their undamaged packaging.
To this end, the claim must be formalized via the form available on the SITE for this purpose or via email sent to the address geral@safetymar.pt . In the claim, the Customer must expressly indicate the reasons for their complaint, always mentioning the order number and their Tax Identification Number (NIF).
The support team for the SITES www.safetymar.pt and www.loja.safetymar.pt will coordinate with the customer on how to proceed with the return of the merchandise, if justified, with SafetyMar, Lda. assuming the costs of returning it and the costs of the new shipment in these cases. Accepted reasons for claims for which SafetyMar, Lda. is responsible include products or sizes not referenced in the order confirmed by the Customer, manufacturing defects, and other damages, provided they are not associated with transport.
If the order is delivered damaged, the customer must complain immediately to the courier and formalize the act at the moment. They must also send evidence of the state of the packaging upon delivery (photos) to the SITE support team via the email geral@safetymar.pt , as well as proof of the complaint filed with the carrier's courier.
In situations where the reasons for the return are not the responsibility of SafetyMar, Lda., the return will be accepted within the previously stipulated period of 14 days after verification of the good condition of the products and their respective packaging, and the value paid by the customer will be refunded, deducting the return shipping costs in accordance with the values defined in point 4 of this document. Consequently, SafetyMar, Lda. reserves the right not to accept returns of products without prior notice, as mentioned above, and that do not meet the same conditions of conformity as on the date of their delivery to the Buyer/Customer (namely, products that have undergone any type of use, transformation, damage, and/or lack of original packaging/accessories/complements).
9. Limitation of liability
The photographs on the SITES are merely illustrative. We recommend that you consult the product characteristics for detailed information. In case of doubt, you should contact the SITE management via the email geral@safetymar.pt or use the shopping cart form and await a response before proceeding with the order. Your order will be saved in the shopping cart until you receive a response.
Despite the efforts of SafetyMar, Lda., some products may have an incorrect price listed, which is why we verify prices whenever we process orders. If the product price is lower than the advertised price, we will refund the difference. If the price is higher, we will inform the customer by email and wait for their decision to accept the new proposal or cancel the order.
10. Registration and protection of personal data
Registration in the Online Store is mandatory when the customer decides to proceed with the purchase of products.
This measure is intended exclusively to prevent errors in the input of customer information by alternative means, thus improving its service.
When registering to use this website, the customer will be asked to create a password. The Customer must keep it strictly confidential, not revealing or sharing it with third parties. The Customer is fully and exclusively responsible for the use of their password, as well as any orders placed with it, even without their knowledge.
In case of forgetfulness, the Customer can use the password recovery link by following the recovery instructions.
The Customer guarantees that the personal data provided is true and accurate and undertakes to notify of any changes thereto. Any losses or damages caused to the online store or third parties resulting from incorrect, inaccurate, or incomplete information in the forms will be the sole responsibility of the Customer.
The services ensured by SafetyMar will always respect the provisions of the Personal Data Protection Law - Law no. 67/98, of October 26, and therefore the personal data provided by customers is collected for the exclusive purpose of Customer account management, billing, communication with Customers, statistical analysis, and direct marketing actions, committing to privacy and security in the processing of each Customer's personal data.
The Customer expressly authorizes SafetyMar, Lda. to send information about products and services that may be of interest to them, using their personal data for direct marketing purposes. 11. Intellectual and industrial property
All texts and images reproduced or represented on the SITES www.safetymar.pt and www.loja.safetymar.pt are the exclusive property of and strictly reserved for SafetyMar, Lda. under authorization from its partners, protected under copyright law as well as intellectual property rights with respect to third parties.
Any total or partial reproduction or representation of the SITES www.safetymar.pt and www.loja.safetymar.pt or all or part of the elements included therein is strictly prohibited without authorization from SafetyMar, Lda.
The corporate names, brands, and distinctive signs exclusive to SafetyMar, Lda., reproduced on the SITES www.safetymar.pt and www.loja.safetymar.pt, are protected under the legal provisions applicable to industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited.
On the SITES www.safetymar.pt and www.loja.safetymar.pt, signs and brands not exclusive to SafetyMar, Lda. are reproduced and authorized by their respective holders.
12. Cookies
Aiming to provide our users with greater speed and personalization of the service provided, SafetyMar, Lda. may use a browser feature known as a “cookie”. A “cookie” is a small text file, automatically saved by the user's computer, which allows for their identification whenever they consult the SafetyMar, Lda. 13. Applicable law and competent jurisdiction
These Terms and Conditions for online purchases on the SITES www.safetymar.pt and www.loja.safetymar.pt are governed by the applicable Portuguese legislation.
The parties agree to submit to the exclusive jurisdiction of the District of the registered office of SafetyMar, Lda. with express waiver of any other, any disputes arising from the interpretation and/or application of these Terms and Conditions for which an amicable settlement cannot be reached.
By using the online store at www.loja.safetymar.pt, the Customer accepts and agrees to these Terms and Conditions and the Privacy Policy and General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
